Bitcoin briefly slid to about $75,700 as US midterm returns handed Democrats the Senate, putting the stalled CLARITY Act back in question

Bitcoin briefly fell to about $75,700 as Democrats won the US Senate. What the midterm result could mean for crypto rules, markets and the CLARITY Act.

US midterm results moved crypto markets overnight. Bitcoin briefly dropped to about $75,700 early Wednesday Asian time as returns pointed to Democrats taking both chambers of Congress, before recovering to around $76,700, CoinDesk reported at 23:48 ET on 3 November (12:48 Macau time, 4 November). Bitcoin had traded close to $78,000 late Tuesday while Americans voted, then shed more than $2,000 as the first results came in, leaving it little changed over 24 hours.

Shortly before that, the Associated Press called the Senate for Democrats. Cointelegraph, citing AP, reported at 23:37 ET that Democrat Josh Turek's win in Iowa brought Democrats and the independents who caucus with them to 51 seats. Decision Desk HQ had earlier projected a Democratic majority in the House of Representatives.

How crypto and wider markets reacted

According to CoinDesk data at the time of its report:

AssetApproximate priceMove
Bitcoin$76,700Little changed over 24 h, after a low near $75,700
Ether$2,260Barely moved
XRP$1.27Up about 1%
SolanaJust under $92Down about 1%
BNBAbout $689Down more than 1%
Zcash (ZEC)About $1,200Up about 5% after a 10% drop on Tuesday

The move was not limited to crypto. CoinDesk reported that S&P 500 futures fell 1.3%, erasing an earlier 0.5% gain, Nasdaq 100 futures dropped 2.3%, the 10-year US Treasury yield slid six basis points to 4.90%, and the MSCI Asia Pacific Index slipped nearly 2%. The dollar fell against most major currencies. CoinDesk noted that investors tend to read a Democratic wave as a sign of tighter regulatory scrutiny, especially of large technology and AI companies, while Treasuries can benefit if divided government limits new tax cuts and spending.

Prediction markets had moved well ahead of the official calls. Cointelegraph reported that by 21:05 ET, traders on Kalshi and Polymarket priced Democratic Senate control at about 99% and House control at nearly 100%, up from roughly 75% for the Senate earlier in the day.

Why the result matters for crypto rules

The main policy question is the CLARITY Act, the bill that would set out how US crypto markets are regulated. It passed the House in July 2025 but failed a Senate procedural vote 49 to 50 in September, according to Jerome de Tychey, president of Ethereum France, quoted by Cointelegraph. He added that if the bill is not passed by January, the next Congress starts again from scratch. CoinDesk separately quoted BTSE chief operating officer Jeff Mei as saying Democrats oppose the bill in its current form.

Cointelegraph reported that Senate control also decides who leads the committees overseeing the industry, affects confirmation of future nominees to regulatory posts, and could bring closer congressional scrutiny of crypto businesses linked to President Donald Trump.

Views from the industry were mixed rather than uniformly negative. De Tychey said conflict-of-interest rules and customer protection duties are "things a mature industry should welcome," pointing to Europe's MiCA framework, but warned that crypto becoming a partisan issue "could set the US back several years." Maylea Ma, deputy general counsel at 1inch, told Cointelegraph she expects the SEC, CFTC and Treasury, rather than Congress, to drive most practical rule changes over the next few years.

Industry money was heavily involved. In Ohio, Democrat Sherrod Brown, a long-time crypto critic, won a race that drew about $63 million in crypto-industry spending, including roughly $56 million from the Fairshake PAC, Cointelegraph reported.
